Terms of service

1. Introductory provisions

1.1. Welcome to the Digitalia website of the Faculty of Arts of Masaryk University, hereafter referred to as Digitalia MUNI ARTS. This service is provided by the Faculty of Arts of Masaryk University, with registered office at Žerotínovo nám. 617/9, 601 77 Brno, company identification No. 00216224, contact address Arne Novák 1/1, 602 00 Brno (hereinafter referred to as the "operator").

1.2. The website of the Digitalia MUNI ARTS service was created with the financial support of the project No. LM2023062 "LINDAT/CLARIAH-CZ - Digital Research Infrastructure for Language Technologies, Arts and Humanities" of the Ministry of Education, Youth and Sports of the Czech Republic, solved in cooperation with the beneficiary, the Faculty of Mathematics and Physics of Charles University.

1.3. Digitalia MUNI ARTS is part of the research infrastructure, its main purpose is to support digital research in the humanities and arts at the Faculty of Arts of Masaryk University (FF MU). The aim is to make available and preserve research data and research results of research teams working at FF MU. The research is supported by the tools of the virtual research environment, which enables the development of scientific collaboration and further utilisation of research data.

1.4. To ensure transparency in the use of research results, we have set out the rules in this document. By accessing the Digitalia MUNI ARTS website and services (furthermore, as "Digitalia MUNI ARTS Services"), you agree to abide by the terms and conditions set forth below ("Terms"). If you do not agree to the Terms of Service, you may not use the Digitalia MUNI ARTS Services.

2. Consent to use the services

2.1. Digitalia MUNI ARTS services are available to the public free of charge and their use is governed by these Terms and Conditions, which serve to define the relationship between the operator and the user of these services.

2.2. By accessing the Digitalia MUNI ARTS Services, you agree to abide by the terms and conditions set forth below, which may be updated or modified as set forth in Section 8 of the Terms.

2.3. Acceptance of the Terms can be indicated by actually using the Digitalia MUNI ARTS services. In such case, you, as the user, acknowledge and agree that the operator considers the user's use of the Digitalia MUNI ARTS services as an expression of acceptance of the Terms from the moment the user actually starts using them.

2.4. If you do not agree to the Terms, you may not use the Digitalia MUNI ARTS Services.

2.5. Access to some features and databases of Digitalia MUNI ARTS services may be restricted. In specific cases of restrictions, users will be notified of this fact.

2.6. Access to sensitive data is restricted to an authorised group of users/researchers. The authorization of researchers is approved by the creators of the individual databases that are part of the Digitalia MUNI ARTS services; by their explicit consent, researchers agree to comply with all restrictions that apply to sensitive data. Before accessing sensitive data, such user must authorize and confirm by pressing the YES button that he/she is aware of the specific restrictions on the handling of sensitive data available in the database in question.

3. Access to Digitalia MUNI ARTS services

3.1. User access

3.1.1. FF MU grants users permission to access and use resources published through Digitalia MUNI ARTS services, which is conditional on compliance with these Terms and Conditions.

3.1.2. The user is responsible for his/her access to Digitalia MUNI ARTS services through the chosen user identity, regardless of whether he/she has read the terms and conditions of the access.

3.1.3. The user understands and acknowledges that the user's identity is not transferable to another entity or person. The user may not allow access to Digitalia MUNI ARTS services through his/her user identity to any other person.

3.2. Types of user access

Digitalia MUNI ARTS services offer three main categories of content with different user access:

3.2.1. Publicly accessible content – unless otherwise specified, data provided by the infrastructure is publicly accessible. The data may be handled in accordance with the stated licence under which the data was made available to the public.

3.2.2. Content for authenticated users data under a restrictive license can be accessed by users who have been authorized. Users request authorization from the database creator, who evaluates the validity of their request. When accessing content under a restrictive license, the system automatically authenticates authorized users based on the identity of the users. The database creator also has the option of using a time embargo. Data items under a time embargo are archived in the repository immediately after the data is imported, but the data is not publicly available until a date specified by the database creator. Until then, only authorized users, usually the research team involved in the creation of the database itself, have access to the data.

3.2.3. Content intended for specific research purposes – this is sensitive data with restricted access limited to a defined group of users. Access is conditional on the user's proper registration as an individual natural person and consent to access sensitive data. Access to the data is granted to these users on the basis of two-level authentication. When logging in, the user confirms a form obliging him/her to handle sensitive data according to specific conditions. If the creator of the database plans to include sensitive data in the platform, he/she is obliged to document the decision of the Masaryk University Research Ethics Committee on the possibility of collecting and storing such data. For an anonymous end user without authentication accessing the data in the Islandora system via a web browser, this content is inaccessible.

3.2.4. The user acknowledges that access to the content may be restricted depending on this categorization and the user's identity. Access to authenticated and exploratory content of Digitalia MUNI ARTS services may be conditioned by the operator upon agreement to additional special license or user terms. The User agrees to use such special content in accordance with these special terms of use.

3.3. Licence Digitalia MUNI ARTS

3.3.1. Digitalia MUNI ARTS and its parts are protected by Act No. 121/2000 Coll., Copyright Act, as amended.

3.3.2. The user is entitled to use Digitalia MUNI ARTS exclusively for his/her personal use, unless otherwise specified in the specific license. The user is also entitled to use Digitalia MUNI ARTS services under the statutory exceptions under the Copyright Act.

3.3.3. In any case, the user undertakes to properly cite Digitalia MUNI ARTS and the creator of the specific content as the source of the data.

3.4. Content-specific licences

3.4.1. In addition to the above limitations related to each category of content and to the Digitalia MUNI ARTS license, specific content made available may have its own license (e.g., a Creative Commons license) that sets additional restrictions and requirements for its use.

3.4.2. In the event of a conflict between the content-specific license and the Digitalia MUNI ARTS license, the content-specific license rules will take precedence. The user agrees to comply with these restrictions and requirements.

4. User obligations

The user undertakes to act in the following manner when using Digitalia MUNI ARTS services:

4.1. When using data obtained through Digitalia MUNI ARTS services, the user is obliged to cite and indicate the use of this infrastructure when reporting the results of scientific work.

4.2. The user undertakes to comply with the regulations in force in the Czech Republic, good morals and these Terms and not to damage the reputation of the operator and the Digitalia MUNI ARTS services or other users in any way.

4.3. The user shall not attempt to interrupt or disrupt the security of the website providing Digitalia MUNI ARTS services, its appearance, integrity or availability, as well as the content or methods of uploading content, or otherwise damage Digitalia MUNI ARTS services or content, other users' access accounts or administrator accounts of the operator, access passwords, servers or network elements.

4.4. It will not attempt to gain unauthorized access to the Digitalia MUNI ARTS services, other user accounts and other computer systems, particularly through hacking or phishing, and will generally not attempt to gain access to any content that has not been intentionally made available on the Digitalia MUNI ARTS services website.

4.5. It will not attempt to improperly obtain any information about other users, including but not limited to their email addresses, particularly for the purpose of sending unsolicited commercial communications.

4.6. It will not use the Digitalia MUNI ARTS services in violation of good morals and generally accepted rules for the use of services provided via the Internet.

5. Limitation of liability Digitalia MUNI ARTS

5.1. The operator is not responsible for the accuracy and completeness of the information made available on the Digitalia MUNI ARTS website and individual platforms

5.2. The operator shall not be liable for any damages that the user may incur in connection with the use of Digitalia MUNI ARTS services.

5.3. The operator does not verify the accuracy of the data entered by the user.

5.4. The operator is not responsible for the content of third-party websites that can be visited through the Digitalia MUNI ARTS services (in particular through links leading outside the Digitalia MUNI ARTS services).

5.5. The operator reserves the right to modify, suspend or discontinue the services or access to the services at any time and without any notice and without any liability to the user.

6. Ethics of data use

6.1. Selected ethical issues related to the use of the platforms' content are included in Section 4 User obligations.

7. Data protection and personal data

7.1. The operator does not collect or process any personal data of users to the extent that would allow their direct identification.

7.2. However, the website uses cookies that can be used to analyse traffic through the MATOMO tool. This technology may process data about user behaviour on the website. Users have the choice to accept cookies and can change their preferences at any time through their browser settings or within the cookie bar displayed.

8. Usage statistics and automatic polling

8.1. Digitalia MUNI ARTS keeps usage statistics as a measure of the readership or other use of Digitalia MUNI ARTS services by authors and researchers. The data collected is used solely for researching user needs and improving the service infrastructure. The data is not passed on to any third parties.

8.2. It is a violation of the Digitalia MUNI ARTS policy for a party to directly or indirectly use the Digitalia MUNI ARTS services to influence or encourage others to influence download information and other usage statistics. As part of its general right to refuse or terminate service and to remove or modify content on the services, operator reserves the right, in its sole discretion, to restrict access, remove content, and modify usage statistics to respond to any activity that is likely to have the above effect.

9. Changes to conditions of use, final provisions

9.1. Only the operator is authorized to change or modify these Terms.

9.2. If these Terms are modified for legal, administrative or other reasons, the operator shall notify the user of such changes by publishing the relevant information on the Digitalia MUNI ARTS website without undue delay.

9.3. If the user continues to use the services after being duly notified of a change to the Terms, the user agrees to the new Terms.

9.4. The Digitalia MUNI ARTS Terms of Service are effective on the date of their publication.

9.5. Users may send questions, suggestions or complaints regarding the Terms to the operator via the contacts listed on the Digitalia MUNI ARTS website.
