Non compliance policy defines procedures for addressing rule violations in order to preserve content quality and ensure the responsible use of the repository.

Purpose of this document 

This document sets out the procedure to be followed in the event of a violation of the rules for creating and using content, the code of ethics, or other principles associated with the Digitalia MUNI ARTS repository (hereinafter referred to as the "repository"). The aim of this procedure is to protect the quality of work, safety, and a respectful environment for all members of the community. 

All users must agree to specific terms, rules, and general guidelines relating to the content of individual platforms. 

This is to ensure the proper use of data in accordance with applicable licensing terms, the protection of potentially sensitive personal data, the fair and responsible use of infrastructure, and generally lawful and ethical conduct in relation to research data. These regulations include Terms of Service, license terms applicable to the content of various platforms, and general guidelines for good scientific practice. 

Sanctions

If the repository staff find out about any violations by users, or are told about them, the repository can take certain measures and act according to this policy and at the discretion of the authorized staff. However, it is important to note that data users are also subject to other applicable laws, particularly in the area of data protection and intellectual property rights, and that failure to comply with certain measures may result in severe legal penalties. 

Below are possible actions that the repository may take if the terms are violated: 

  • the relevant user account may be immediately blocked, either temporarily or permanently, depending on the severity of the violation; 
  • the user's access to the data file will be immediately revoked; 
  • the user may not continue to work with the data and must delete all copies; 
  • future requests for access to the repository may be restricted or completely denied; 
  • the relevant authority may be notified in the event of a violation of national or EU legislation. 

 In cases of serious breaches of scientific ethics – such as falsification or manipulation of data, plagiarism, or other unethical conduct – the repository may inform the employer or institution with which the user is associated, especially if there is a relevant body that deals with such cases (e.g., the ethics committee of a research institution). This may lead to further action or sanctions by the institution concerned, which are beyond the scope of the repository's responsibility. 

Liability

Digitalia MUNI ARTS is not liable in the event of non-compliance with the terms and conditions by users of its services. Users are sufficiently informed about the terms and conditions of use and access to the repository content and must agree to them. If the repository discovers or receives information about non-compliance or inappropriate behavior in relation to the terms of access (including terms of service and licensing terms) and terms of use, the repository may take action in accordance with these principles.
